RESOLUTION NO. <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> SUPPORTING THE EARLY PAYOFF OF THE EAST BAY DISCHARGE <br /> AUTHORITY (EBDA) DEBT BY THE LIVERMORE-AMADOR VALLEY WATER <br /> MANAGEMENT AGENCY (LAVWMA) FROM THE REGIONAL WASTEWATER <br /> EXPANSION FUND <br /> WHEREAS, the City is a member agency of the Livermore-Amador Valley Water <br /> Management Agency (LAVWMA) Joint Powers Agency (JPA); and <br /> WHEREAS, LAVWMA was created in 1974 when the three entities (cities of <br /> Livermore and Pleasanton, and Dublin San Ramon Services District (DSRSD)) agreed to <br /> cooperate in the construction, operation and maintenance of facilities for the disposal of <br /> treated wastewater from the Livermore-Amador Valley; and <br /> WHEREAS, the treated wastewater from the LAVWMA system discharges into a <br /> pipeline owned by the East Bay Discharge Authority (EBDA) before it is discharged to <br /> through a deep-water outfall into the San Francisco Bay; and <br /> WHEREAS, LAVWMA is considering the early payoff of the EBDA outstanding <br /> debt of$4,373,601; and <br /> WHEREAS, Pleasanton's portion of the debt is $1,537,941; and <br /> WHEREAS, Pleasanton's portion of the debt is collected in the wastewater <br /> connection fees that the City collects on behalf of the Dublin San Ramon Services District <br /> (DSRSD); and <br /> WHEREAS, Pleasanton's portion of the debt would be paid from the Regional <br /> Wastewater Expansion fund. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1: That the forgoing recitals are true and correct. <br /> SECTION 2: That the sole purpose is for the early payoff of the EBDA debt by <br /> LAVWMA. This resolution does not bind the City to make expenditure of City funds, nor <br /> incur indebtedness. <br /> SECTION 3: Supports the early payoff of the EBDA debt by LAVWMA. <br /> Pleasanton's portion of the debt would be paid by DSRSD from the Regional Wastewater <br /> Expansion fund. <br />
