RESOLUTION NO. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON SUPPORTING THE EARLY PAYOFF OF THE EAST BAY DISCHARGE AUTHORITY (EBDA) DEBT BY THE LIVERMORE-AMADOR VALLEY WATER MANAGEMENT AGENCY (LAVWMA) FROM THE REGIONAL WASTEWATER EXPANSION FUND WHEREAS, the City is a member agency of the Livermore-Amador Valley Water Management Agency (LAVWMA) Joint Powers Agency (JPA); and WHEREAS, LAVWMA was created in 1974 when the three entities (cities of Livermore and Pleasanton, and Dublin San Ramon Services District (DSRSD)) agreed to cooperate in the construction, operation and maintenance of facilities for the disposal of treated wastewater from the Livermore-Amador Valley; and WHEREAS, the treated wastewater from the LAVWMA system discharges into a pipeline owned by the East Bay Discharge Authority (EBDA) before it is discharged to through a deep-water outfall into the San Francisco Bay; and WHEREAS, LAVWMA is considering the early payoff of the EBDA outstanding debt of$4,373,601; and WHEREAS, Pleasanton's portion of the debt is $1,537,941; and WHEREAS, Pleasanton's portion of the debt is collected in the wastewater connection fees that the City collects on behalf of the Dublin San Ramon Services District (DSRSD); and WHEREAS, Pleasanton's portion of the debt would be paid from the Regional Wastewater Expansion fund. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1: That the forgoing recitals are true and correct. SECTION 2: That the sole purpose is for the early payoff of the EBDA debt by LAVWMA. This resolution does not bind the City to make expenditure of City funds, nor incur indebtedness. SECTION 3: Supports the early payoff of the EBDA debt by LAVWMA. Pleasanton's portion of the debt would be paid by DSRSD from the Regional Wastewater Expansion fund.
