BACKGROUND <br /> As a general law city, many of the provisions of the Pleasanton Municipal Code must <br /> reflect California law. Each year, city staff track changes in state law and propose <br /> related municipal code amendments. In addition, the municipal code can be updated to <br /> reflect current city practices, as well as delete out-of-date provisions and references. <br /> Many of these changes are too minor to warrant a stand-alone staff report and council <br /> action. Thus, staff combines these non-controversial updates into a single omnibus <br /> ordinance. <br /> During this omnibus review, related changes are often proposed to the Master Fee <br /> Schedule and for resolutions to reflect other city practices. <br /> DISCUSSION <br /> Each of the proposed amendments to the municipal code are described below and <br /> shown in Attachment 1.1 <br /> §1.24.125 Right to judicial review. Amendment to clarify that an action, not solely a <br /> petition, may be filed pursuant to Cal. Government Code §53069.4 by a person <br /> aggrieved by an administrative decision. Also updates reference from municipal court <br /> to superior court because California no longer has municipal courts. <br /> Ch. 3.40 Delete the expired North Sycamore area development impact fee. The North <br /> Sycamore Area Development Impact Fee was adopted in 1999 by Ordinance No. 1772, <br /> and is codified in Chapter 3.40. By its terms (see §3.40.120), the fee expired after <br /> fifteen years in 2014. Chapter 3.40 is proposed to be removed from the municipal code <br /> because this fee has expired and is no longer in effect. No related change is proposed <br /> for the Master Fee Schedule as this fee was no longer listed therein after its expiration. <br /> §§11.52.010 — 11.52.050 Remove local bicycle licensing requirement. For many years, <br /> the Police Department has noted that bicycle theft and resale occurs via on-line <br /> platforms nationally for valuable bicycles, and less valuable bicycles are chopped up for <br /> parts or scrap metal. As such, the local registration of bicycles to aid recovery after <br /> theft is no longer effective. Therefore, the local bicycle registration requirements in <br /> §§11.52.010-050, first adopted by Ordinance No. 819 in 1977 are proposed to be <br /> deleted, as well as the bicycle licensing fees in the Master Fee Schedule (see <br /> below). The Police Department will instead refer interested bicycle owners to 529 <br /> Garage, a national bicycle registration company. 529 Garage has joined with the <br /> National Bike Registry to create the largest online bicycle registry in the United States. <br /> Registration with 529 Garage is free of charge. <br /> §11.64.060 Clarify rights of special event street closure permit holders. When an <br /> organization or person receives a special event street closure permit or a parade permit <br /> ' The ordinance shows proposed amendments in track changes. If introduced by the council on <br /> May 1st, at the subsequent meeting where the ordinance is adopted /second reading, the <br /> amendments will be shown in final form as required by the code compilation company. <br /> Page 2 of 5 <br />
