BACKGROUND
The weed abatement program, provided in Government Code sections 39560 — 39588,
established a mechanism for assuring the removal of weeds, dirt, rubbish and refuse on
specified properties that constitute a public nuisance. All of the owners of properties
included in the attached Exhibit A have been mailed a Notice to abate the nuisance on
their parcels which included the public hearing date. In cases where there was an
insufficient mailing address, the notice was posted conspicuously on the property. Each
notice was sent with a list of weed abatement standards. A proof of service was
completed by the Fire Department for our files to certify what documents were sent to the
property owners.
DISCUSSION
At this hearing, after considering any objections to the proposed abatement, it is
recommended that the City Council overrule the objections to the proposed abatement,
and/or amend the list of properties to be abated. The City Council should then adopt the
attached resolution, as amended (if at all), that orders a contractor to abate the weeds
on the properties attached in Exhibit A.
After this hearing, Fire Inspectors will survey each parcel listed for compliance. If
abatement has not occurred by May 31, 2018, a contractor will abate the weeds. At a
public hearing this summer, staff will recommend that the City Council order that the
abatement costs be a special assessment and lien imposed on the properties requiring
abatement for any outstanding invoices.
Submitted by: Fiscal view: Approved y:
Ruben Torres Tina Olson Nelson Fialho
Fire Chief Director of Finance City Manager
Attachments:
1.
