lines, water and sanitary sewer mains, and the public restroom will be owned and <br /> maintained by the City. <br /> The bio-swales for stormwater treatment located on Parcels A and B and fronting <br /> various lots throughout the development will be maintained by a homeowners <br /> association specifically created for this project. <br /> Subdivision Agreement <br /> In addition to guaranteeing the work proposed for the development, the Subdivision <br /> Agreement also includes provisions for the reimbursement of 75 percent of the cost of <br /> replacing the public water main on Valley Trails Drive. <br /> As noted previously, Ponderosa has provided a cost proposal for $234,643 to replace <br /> the existing public water main. The proposal provides for the: <br /> • Abandonment of the existing public water main and installation of a new public <br /> water main on Valley Trails Drive between Petrified Forest Court and Lassen <br /> Street. <br /> • Installation of water main extensions from the new water main on Valley Trails <br /> Drive into Petrified Forest Court, Grand Canyon Court, Mesa Verde Court, and <br /> Lassen Street to accommodate future water main replacements in those streets <br /> without disruption to proposed pavement treatments that will be completed on <br /> Valley Trails Drive by the development. <br /> • Installation of a new service lateral to an existing fire hydrant on Valley Trails <br /> Drive. <br /> • Prevailing wage rates for work related to the replacement of the existing water <br /> main. <br /> The Subdivision Agreement provides for this reimbursement to Ponderosa (see <br /> Attachment 5). The reimbursement of$175,982.25 will be processed following City <br /> Council acceptance of the public improvements of the development. <br /> Discretion to Deny the Final Map <br /> The approval of the Final Map, when the Final Map substantially complies with the <br /> conditions of the Vesting Tentative Map, is a mandatory, ministerial act (Government <br /> Code, Section 66474.1). A Final Map shall be disapproved only for failure to meet <br /> conditions that were applicable at the time the Vesting Tentative Map was approved. If <br /> the Final Map is disapproved, there must be a finding identifying the conditions which <br /> were not met (Government Code, Section 66473). <br /> Page 3 of 4 <br />
