WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 04-005 <br /> <br />RESOLUTION AUTHORIZING SETTLEMENT OF A WORKERS' <br />COMPENSATION CLAIM <br /> <br />there is now pending before the Workers' Compensation Appeals Board a case <br />concerning a retired fire captain (Anthony Lukaszewski); and <br /> <br />the City Attorney has requested authority from the City Council to settle this claim in the <br />amount discussed in the memorandum from the City's Human Resources Manager to the <br />City Attorney; and <br /> <br />such request is reasonable and justified under the circumstances. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br />The City Attorney is authorized to settle the above-mentioned case in the amount not to <br />exceed that requested by the City's Human Resources Manager. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND REGULARLY <br />ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT A <br />MEETING HELD ON FEBRUARY 3, 2004 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers-Ayala, Brozos~,Campbell, Hosterman, aM M~orPico <br />NONE <br />NONE <br />NONE <br /> <br /> ATTEST: /~. <br />~'l~wn G.
