ORDINANCE NO. 2177 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING MUNICIPAL CODE CHAPTER 9.04 NOISE REGULATIONS TO DELETE SECTION 9.04.045 LEAF BLOWERS, THEREBY SUBJECTING LEAF BLOWERS TO GENERAL NOISE TIME RESTRICTIONS AND DECIBEL LIMITS WHEREAS, the City of Pleasanton supports the reduction of noise to acceptable levels throughout the community (see General Plan Noise Element - Goal 1); and WHEREAS, the current noise limit time restrictions for leaf blowers allow for earlier starting times (6 a.m.) than for general activities (8 a.m.), and this early start time has resulted in residents' complaints about mornings disrupted by leaf blowers; and WHEREAS, the specified leaf blower models listed in the code are out-of-date, and allowing leaf blowers to generate up to 73 decibels at 50 feet is no longer needed as current models are quieter according to the landscapers' association; and WHEREAS, deleting the expanded times and higher decibel levels for leaf blower operation would make them subject to general noise time restrictions and decibel limits (see Municipal Code §9.04.070), which will benefit residents' quiet enjoyment in their homes, as well as support the General Plan Noise Element provision regarding reducing outdoor noise levels in existing residential areas (see Policy 2). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Finds that the amendment to the Municipal Code has no possibility to have a significant effect on the environment per Title 14 California Code of Regulations §15061(b)(3). Section 2. Amends the Municipal Code by deleting Section 9.04.045 Leaf Blowers: 9.04.045 I eaf blowers A. Weekdays. 1. On Monday through Friday, no person shall operate a motor powered leaf blower between the hours of 10:00 p.m. and 6:00 a.m. 2. On Monday through Friday, between the hours of 6:00 a.m. and 50 feet.
