Councilmember Narum thanked all participants in the public hearing. She agreed with
Councilmember Pentin's comments regarding the difficulty of making decisions which involve
disparity between various resident preferences. She noted this is a one-year contract, with options
to extend, and not a long-term commitment. She supported staff's recommendation and stated
her preference that staff work with PCRT to explore rental opportunities at the Firehouse venue.
Councilmember Olson expressed his support for staff's recommendation and noted his decision is
based upon the importance of"community" and "budget" at this time.
Mayor Thorne inquired why the venue is limited to three shows per year and whether a third show
can be coordinated with PCRT.
City Manager Fialho stated he will follow up with both theatre companies relative to guidelines and
policies for the contract and other rental opportunities at the Firehouse.
MOTION: It was m/s by Brown/Olson to approve and authorize the City Manager to execute an
agreement with Tri-Valley Repertory Theatre for theatrical production services for Civic Arts
Presents not to exceed $130,000 annually. Motion passed by the following vote:
Ayes: Councilmembers Brown, Narum, Pentin, Olson, Mayor Thorne
Noes: None
Absent: None
19. Moved from the Consent Calendar — Introduce an ordinance to amend Pleasanton Municipal
Code Chapter 9.04 Noise Regulations to delete Section 9.04.045 Leaf blowers, thereby subjecting
leaf blowers to general noise time restrictions and decibel limits
Director of Community Development Gerry Beaudin presented the report which includes
amendments to the City's Noise Ordinance as a response to community complaints regarding
leaf-blowers. Currently, the complaints received are not violations of the Municipal Code, which
allows operation of leaf-blowers at 73 decibels from 6:00 a.m. to 10:00 p.m. in residential zones.
The Noise Ordinance restricts noise to 70 decibels, and the proposed Ordinance will create
uniformity to the code by deleting the current leaf-blower section, and restrict hours of operation to
8:00 a.m. to 8:00 p.m. Monday through Saturday, and 10:00 a.m. to 6:00 p.m. Sundays and
holidays. Leaf-blower users will have to comply with the general 70 decibel noise limits after the
ordinance is amended.
Mayor Thorne described the significant decrease in sound with only a 3 decibel change. Director
Beaudin provided examples of various decibel levels, noting a vacuum cleaner is approximately
70 decibels and standing next to an operating garbage disposal can register at 80 decibels.
Councilmember Brown acknowledged this matter was a response to complaints regarding quality
of life, which has been impacted by leaf-blower noise. She inquired whether the decibel level is
registered at the fence line or at the site. Director Beaudin responded the levels were different per
district and for residential, it would be registered at any point outside of the property plane (vertical
dimension of the property line). He also confirmed City staff will contact business license holders,
local contractors, and the local business associations to inform them of the changes and for
enforcement.
Councilmember Narum inquired regarding enforcement of the new regulations. Director Beaudin
responded the regulations were adjusted based upon repeated complaints regarding noise and
staff has a plan to respond to "habitual offenders" and also approach business owners holding
licenses with the City.
City Council Minutes Page 11 of 12 March 20,2018
