within thirty (30) days of the effective date of this Article; failure to do so shall make continued operation of said place of business a violation of Section 4-2.1432 hereo f. Sec. 4 -2.14 31. Rule.s .an .d Regulations. The Chief of Police may make and enforce reasonable rules and regulations in connection with enforcement function not in conflict with, but to carry out, the intent of this Chap te r. Sec. 4-2.1432. Violation and Penalty. (a) Every person, except those persons who are speci- fically exempted by this Chapter, whether acting as an indi- vidual, owner, employee of the owner, operator or employee of the operator, or whether acting as a mere helper for the owner, employeel or operator, or whether acting as a partici- pant or worker in any way, who gives massages or conducts a massage establishment or room who does or practices any of the other things or acts mentioned in this Chapter without first obtaining a permit and paying for a license to do so from the City or shall violate any provision of this chapter shall be guilty of a misdeamor. (b) Any owner, operator, manager, or permittee in charge or in control of a massage establishment who knowingly employs a person performing as a masseur as defined in this Chapter who is not in possession of a valid permit or who allows such an employee to perform, operate, or practice within such a place of business is guilty of a misdeamor, and upon conviction such person shall be punished as provided in Title 1, Chapter 2 of this Code. Sec, 4-2.1433. S.everab~lity. If any section, subsection, subdivision, paragraph; sentence, clause or phrase of this Chapter or any part thereo~ is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of th, remaining portions of this Chapter or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence ~ clause or phrase thereof irrespective of the fact that any one or more sections, subsections; subdivisions, paragraphs, sentenc~ s, clauses or phrases be declared unconstitutional or invalid or ine ffect i ve. Section 2. This ordinance shall be in full force and effect thirty (30) days after the date of its final passage and adoption. Section 3. This ordinance shall be published once 'within fifteen (15) days after its adoption in the "THE TIMES", a news- paper of general circulation, published in the City of Pleasanton. -11-
