Rule.s .an .d Regulations. <br /> <br /> The Chief of Police may make and enforce reasonable <br /> rules and regulations in connection with enforcement function <br /> not in conflict with, but to carry out, the intent of this <br /> Chap te r. <br /> <br /> Sec. 4-2.1432. Violation and Penalty. <br /> <br /> (a) Every person, except those persons who are speci- <br /> fically exempted by this Chapter, whether acting as an indi- <br /> vidual, owner, employee of the owner, operator or employee of <br /> the operator, or whether acting as a mere helper for the <br /> owner, employeel or operator, or whether acting as a partici- <br /> pant or worker in any way, who gives massages or conducts a <br /> massage establishment or room who does or practices any of <br /> the other things or acts mentioned in this Chapter without <br /> first obtaining a permit and paying for a license to do so <br /> from the City or shall violate any provision of this chapter <br /> shall be guilty of a misdeamor. <br /> <br /> (b) Any owner, operator, manager, or permittee in <br /> charge or in control of a massage establishment who knowingly <br /> employs a person performing as a masseur as defined in this <br /> Chapter who is not in possession of a valid permit or who <br /> allows such an employee to perform, operate, or practice <br /> within such a place of business is guilty of a misdeamor, <br /> and upon conviction such person shall be punished as provided <br /> in Title 1, Chapter 2 of this Code. <br /> <br /> Sec, 4-2.1433. S.everab~lity. <br /> <br /> If any section, subsection, subdivision, paragraph; <br /> sentence, clause or phrase of this Chapter or any part thereo~ <br /> is for any reason held to be unconstitutional or invalid or <br /> ineffective by any court of competent jurisdiction, such <br /> decision shall not affect the validity or effectiveness of th, <br /> remaining portions of this Chapter or any part thereof. The <br /> City Council hereby declares that it would have passed each <br /> section, subsection, subdivision, paragraph, sentence ~ clause <br /> or phrase thereof irrespective of the fact that any one or <br /> more sections, subsections; subdivisions, paragraphs, sentenc~ s, <br /> clauses or phrases be declared unconstitutional or invalid or <br /> ine ffect i ve. <br /> <br />Section 2. This ordinance shall be in full force and effect <br />thirty (30) days after the date of its final passage and adoption. <br /> <br /> Section 3. This ordinance shall be published once 'within <br />fifteen (15) days after its adoption in the "THE TIMES", a news- <br />paper of general circulation, published in the City of Pleasanton. <br /> <br /> -11- <br /> <br /> <br />
