CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 705 <br /> <br /> AN ORDINANCE ADDING ARTICLE 14 TO CHAPTER 2 (SPECIAL <br /> PERMITS), TITLE IV, (HEALTH, SAFETY, MORAL AND GENERAL <br /> WELFARE) OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON <br /> RELATING TO THE LICENSING AND REGULATION OF MASSAGE <br /> ESTABLISHMENTS AND OUTCALL MASSAGE SERVICE. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br /> Section 1. Article 14 is hereby added to Chapter 2, Title <br /> <br />IV of the Ordinance Code of the City of Pleasanton to read as <br />follows: <br /> <br /> ARTICLE 14. LICENSING REQUIREMENT AND REGULATIONS FOR <br /> MASSAGE ESTABLISHMENTS AND OUTCALL MASSAGE SERVICE. <br /> <br /> Sec. 4-2.1401. Definitions. <br /> <br /> For the purpose of this chapter, the following words <br /> and phrases shall have the following meaning: <br /> <br /> (a) "Massage." Pressure on, or friction against, <br /> stroking and kneading the body by manual or mechanical <br /> me a i1 s . <br /> <br /> (b) "Massage establishment." Any establishment <br /> wherein massage is given, engaged in or carried on, or <br /> permitted to be given, engaged in, or carried on, either <br /> as a primary or secondary function. <br /> <br /> (c) "Outcall massage service." Any business, not <br /> licensed as a massage establishment under the provisions <br /> of this article, wherein the principal function is such <br /> that massage is given, engaged in, or carried on, or per- <br /> mitted to be given, engaged in, or carried on. <br /> <br /> (d) "Masseur." Any person who engages in the practice <br /> f massage as herein defined. Masseur shall also include <br /> ° <br /> masseuse, as the use of the masculine gender shall include <br /> in all cases the feminine gender as well <br /> <br /> (e) "Person." Any individual, copartnership, firm, <br /> association, joint stock company, corporation, or combin- <br /> ation of individuals of whatever form or character. <br /> <br /> (f) "Employee" shall include all persons paid dir- <br /> ectly by the permittee on a rnonthly~ weekly or hourly basis <br /> except that persons, other than masseurs, rendering service <br /> as an independent contractor shall not be deemed an employee <br /> ~vithin the meaning of this article. <br /> <br /> (g) ~'City Health Officer." Health Officer of the <br /> County of Alameda or his authorized representative. <br /> <br /> <br />
