THE CITY OF G <br /> )7,7CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON® <br /> March 20, 2018 <br /> Community Development <br /> Planning Division <br /> TITLE: INTRODUCE AN ORDINANCE TO AMEND MUNICIPAL CODE <br /> CHAPTER 9.04 NOISE REGULATIONS TO DELETE SECTION 9.04.045 <br /> LEAF BLOWERS, THEREBY SUBJECTING LEAF BLOWERS TO <br /> GENERAL NOISE TIME RESTRICTIONS AND DECIBEL LIMITS <br /> SUMMARY <br /> Current Pleasanton Municipal Code (PMC) Section 9.04.045 allows the use of leaf <br /> blowers to begin earlier (6 a.m.), end later (10 p.m.) and operate at a higher decibel <br /> level (73 dBA at 50 feet) than what is generally allowed within both the residential and <br /> commercial zoned districts. This earlier start time for leaf blowers has resulted in <br /> residential noise complaints. PMC Section 9.04.045, which was adopted in 1988, is <br /> currently out of date. Deleting PMC Section 9.04.05 would bring the use of leaf blowers <br /> in line with the general noise ordinance requirements for each zoning district, which also <br /> regulates noise from other landscaping equipment such as lawn mowers, trimmers and <br /> weed eaters. <br /> RECOMMENDATION <br /> Introduce an ordinance to amend PMC Chapter 9.04 to delete Section 9.04.045 — Leaf <br /> Blowers, thereby making them subject to stricter time limits and maximum noise levels <br /> of the general noise regulations. <br /> FISCAL IMPACT <br /> The municipal code amendment will have no financial impact. Noise complaints <br /> continue to be addressed by existing Code Enforcement and Police Department staff on <br /> a complaint-made basis. <br />
