Mayor Thorne called for a recess at 9:05 p.m. The meeting reconvened at 9:15 p.m. with all Members present except Mayor Thorne. 16. Presentation and discussion of proposed Johnson Drive Economic Development Zone Transportation Fee Vice Mayor Olson announced the Mayor has recused himself on this matter and left the Chamber. Director of Finance Tina Olson presented the staff report on the Johnson Drive Economic Development Zone; the purpose of the JDEDZ, transportation improvements required to accommodate increased daily trips at full build-out; allocation of $15 million dollars for transportation improvements, timing of development and unknown retail; proposed transportation fee; credits and next steps. Councilmember Pentin asked whether staff has a number for the right-of-way credits on all parcels and Ms. Olson reported the total estimated cost for the right-of-way is $1.5 million, which will mostly be on Johnson Drive, but staff will not know the exact right-of-way to be required from each parcel until they complete the detailed design. Mr. Fialho reported Council will set the upper limit the City can recover, and staff would structure an ordinance accordingly, which would be presented to Council. He addressed the possibility of a property owner not being able to pay the fee and commented on fee recovery being a Council policy and noted the need to not create an unfair condition between property owners. The City would need to be universal in its approach and staff will push for as much recovery as possible. Councilmember Brown commented against getting less than 100% recovery and questioned why the City would give away taxpayer money. City Manager Fialho reported the City recognizes property owners will be dedicating right-of-way and have commissioned a lot of work that has been accounted and tracked and staff may recommend Council consider that. Vice Mayor Olson noted there were no speakers to address this item. MOTION: It was m/s Pentin/Narum to have staff work to finalize the transportation fee, work with property owners and bring the matter back to Council for future consideration.
