ORDINANCE NO. 2176 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING <br /> MUNICIPAL CODE CHAPTER 14.20 RECYCLED WATER USE FOR LANDSCAPE <br /> IRRIGATION AND SECTION 14.04.060 USE OF WATER SERVICE <br /> WHEREAS, the City of Pleasanton supports the use of recycled water for landscape irrigation <br /> as a beneficial alternative water supply to protect the limited potable water supply during all levels of <br /> water supply availability, in accordance with Section 13550 et seq., of the California Water Code and <br /> Section 65605 of the California Government Code; and <br /> WHEREAS, Municipal Code Chapter 14.20 Recycled Water for Landscape Irrigation sets forth <br /> the regulatory guidance on the mandatory connection of eligible water irrigation meters within the <br /> recycled water use area for landscaped areas within new and existing development, as well as a defined <br /> process of exemption from connection to the recycled water system; and <br /> WHEREAS, the City of Pleasanton supports Governor Brown's Executive Order B-40-17 <br /> recognizing the importance of the permanent elimination of wasteful practices of potable water use: and <br /> WHEREAS, the amendment to Municipal Code Section 14.04.060 Use of Water Service will <br /> expand the definition of potable water waste to include the use of potable water for landscape irrigation <br /> through dedicated irrigation meters within the recycled water use area, unless otherwise exempted from <br /> recycled water connection as specified within the Municipal Code. or determined unable to connect by <br /> the City; and <br /> WHEREAS, the amendment to Municipal Code Chapter 14.20 will include a failure to comply <br /> section to set forth the parameters of expected customer cooperation in the process of connecting to <br /> recycled water service, and recognize the potential need for discontinuance of exempted potable water <br /> irrigation meters to protect public health and safety during times of potable water shortage if declared <br /> under activation of Municipal Code Chapter 9.30 Water Management Plan; and <br /> WHEREAS, these amendments support the General Plan Water Element provisions regarding <br /> sufficient water supply and water recycling (see Goals 1 and 4, Policies 1 and 4, and Programs 1.5 and <br /> 4.5). <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br /> ORDAIN AS FOLLOWS: <br /> SECTION 1. Finds that the amendments to the Municipal Code have no possibility to have a <br /> significant effect on the environment per Title 14 California Code of Regulations §15061(b) (3). <br /> SECTION 2. Amends Municipal Section 14.04.060 Use of Water Service as set forth in the <br /> attached Exhibit A. <br /> SECTION 3. Amends Municipal Code Chapter 14.20 Recycled Water Use for Landscape <br /> Irrigation as set forth in the attached Exhibit B. <br /> SECTION 4. A summary of this ordinance shall be published once within fifteen (15 days after <br /> its adoption in "The Valley Times", a newspaper of general circulation published in the City of <br /> Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office <br /> within fifteen (15) days after its adoption. <br /> 1 <br />
