ORDINANCE NO. 2173 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF STONERIDGE PROPERTIES, L.L.C. <br /> (SIMON PROPERTY GROUP) TO AMEND THE STONERIDGE SHOPPING <br /> CENTER DEVELOPMENT AGREEMENT, GOVERNING AN APPROXIMATELY <br /> 362,790 SQUARE-FOOT EXPANSION, FOR AN ADDITIONAL FIVE YEARS, AS <br /> FILED UNDER CASE P17-0904 <br /> WHEREAS, Stoneridge Properties, LLC (Simon Property Group) has applied for an <br /> extension of the Development Agreement for the properties at 1008 — 1700 Stoneridge Mall <br /> Road for an additional five years regarding an approximately 362,790 square foot remaining <br /> permitted expansion to the Stoneridge Shopping Center, as filed under Case P17-0904; <br /> and <br /> WHEREAS. a Supplemental Environmental Impact Report (SEIR) was prepared <br /> and certified on January 4, 2012 for the Housing Element update and Climate Action Plan <br /> General Plan Amendments and Rezonings that supplemented the Environmental Impact <br /> Report (EIR) prepared for the Pleasanton 2005-2025 General Plan, certified in July 2009. <br /> This SEIR anticipated completion of the subject 362,790 square foot expansion of the <br /> Stoneridge Shopping Center. The California Environmental Quality Act (CEQA) specifies <br /> that individual development projects that are covered by a certified EIR or SEIR are exempt <br /> from additional environmental review, therefore there is no additional environmental <br /> document regarding this Development Agreement extension; and <br /> WHEREAS. the Planning Commission adopted Resolution No. PC-2017-28, <br /> recommending to the Pleasanton City Council that P17-1820 be approved; and <br /> WHEREAS, on December 19, 2017, the Pleasanton City Council held a duly noticed <br /> public hearing on this application and considered all public testimony, agenda reports, and <br /> related materials, and the recommendations of City staff and the Planning Commission; and <br /> WHEREAS, the Pleasanton City Council finds that the proposed extension of the <br /> Development Agreement is consistent with the City's General Plan. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves Case P17-0904, the application by Stoneridge Properties. <br /> LLC (Simon Property Group) for an extension of the Development Agreement for its <br /> property at 1008 — 1700 Stoneridge Mall Road for an additional five years, and directs the <br /> City Manager to execute the Third Amendment to the Development Agreement as generally <br /> shown in the attached Exhibit A, which may be modified as determined by the City Manager <br /> and City Attorney for consistency with this City Council action prior to execution. <br /> SECTION 2. The 362,790-square-foot expansion of the Stoneridge Shopping <br /> Center was considered in the Supplemental Environmental Impact Report (SEIR) and <br /> adopted Findings and Statements of Overriding Consideration approved by the City Council <br /> on January 4, 2012 for the Housing Element update and Climate Action Plan General Plan <br /> Page 1 <br />
