ATTACHMENT # 4 <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING MUNICIPAL CODE CHAPTER 14.20 RECYCLED WATER USE FOR <br /> LANDSCAPE IRRIGATION AND SECTION 14.04.060 USE OF WATER SERVICE <br /> WHEREAS, the City of Pleasanton supports the use of recycled water for landscape <br /> irrigation as a beneficial alternative water supply to protect the limited potable water supply <br /> during all levels of water supply availability, in accordance with Section 13550 et seq., of the <br /> California Water Code and Section 65605 of the California Government Code; and <br /> WHEREAS, Municipal Code Chapter 14.20 Recycled Water for Landscape Irrigation <br /> sets forth the regulatory guidance on the mandatory connection of eligible water irrigation <br /> meters within the recycled water use area for landscaped areas within new and existing <br /> development, as well as a defined process of exemption from connection to the recycled <br /> water system; and <br /> WHEREAS, the City of Pleasanton supports Governor Brown's Executive Order B-40- <br /> 17 recognizing the importance of the permanent elimination of wasteful practices of potable <br /> water use; and <br /> WHEREAS, the amendment to Municipal Code Section 14.04.060 Use of Water <br /> Service will expand the definition of potable water waste to include the use of potable water <br /> for landscape irrigation through dedicated irrigation meters within the recycled water use <br /> area, unless otherwise exempted from recycled water connection as specified within the <br /> Municipal Code, or determined unable to connect by the City; and <br /> WHEREAS, the amendment to Municipal Code Chapter 14.20 will include a failure to <br /> comply section to set forth the parameters of expected customer cooperation in the process <br /> of connecting to recycled water service, and recognize the potential need for discontinuance <br /> of exempted potable water irrigation meters to protect public health and safety during times of <br /> potable water shortage if declared under activation of Municipal Code Chapter 9.30 Water <br /> Management Plan; and <br /> WHEREAS, these amendments support the General Plan Water Element provisions <br /> regarding sufficient water supply and water recycling (see Goals 1 and 4, Policies 1 and 4, <br /> and Programs 1.5 and 4.5). <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. Finds that the amendments to the Municipal Code have no possibility to <br /> have a significant effect on the environment per Title 14 California Code of Regulations <br /> §15061(b)(3). <br /> Section 2. Amends Municipal Section 14.04.060 Use of Water Service as set forth <br /> in the attached Exhibit A. <br /> 1 <br />
