California Health and Safety Code sections 13800 et seq., and such fire code and <br /> fire ordinances as may adopted and revised from time-to-time by Livermore and <br /> Pleasanton), emergency rescue, and dispatch services, as well as administration <br /> and support necessary to provide those services. <br /> Livermore. The term "Livermore" means the existing municipal corporation known <br /> as the City of Livermore, a general law city duly organized and existing under and <br /> by virtue of the laws and the constitution of the State of California. <br /> Original Agreement. The term "Original Agreement" means Joint Exercise of <br /> Powers Agreement between the City of Livermore and the City of Pleasanton <br /> creating the Livermore-Pleasanton Fire Department Joint Powers Authority dated <br /> December 3, 1996. <br /> Pleasanton. The term "Pleasanton" means the existing municipal corporation <br /> known as the City of Pleasanton, a general law city duly organized and existing <br /> under and by virtue of the laws and the constitution of the State of California. <br /> Parties. The term "Parties" means collectively the City of Livermore and the City <br /> of Pleasanton. <br /> Real Property Schedule.. The term "Real Property Schedule" means the schedule <br /> of properties each Party owns and makes available, contributes, or leases to the <br /> Authority, as described in Section 6(A) and Attachment E: <br /> Vehicle and Equipment Schedule. The term "Vehicle and Equipment Schedule" <br /> means the schedule of vehicles, equipment, and other properties made available, <br /> contributed, or leased by each Party to the Authority, as described in Section 6(A) <br /> and the template in Attachment D. <br /> 2000 Agreement. The term "2000 Agreement" means the Joint Exercise of Powers <br /> Agreement between the City of Livermore and the City of Pleasanton creating the <br /> Livermore-Pleasanton Fire Department Joint Powers Authority dated August 1, <br /> 2000, which revised the Original Agreement. <br /> SECTION 2. PURPOSE <br /> The purpose of the Authority is to operate the Livermore-Pleasanton Fire <br /> Department to efficiently provide Fire Protection Services for the Parties at the level of <br /> service that Livermore and Pleasanton each .determineto be appropriate for its own <br /> jurisdiction. . <br /> The purpose of this Amended and Restated Agreement is to enumerate the <br /> Authority's duties, responsibilities, and powers, which may be amended from time-to-time <br /> by the Parties. <br /> AMENDED AND RESTATED AGREEMENT FOR THE LIVERMORE-PLEASANTON <br /> FIRE DEPARTMENT JOINT POWERS AUTHORITY <br /> Page 4 <br />
