Attachment 1 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF <br />LIVERMORE AND THE CITY OF PLEASANTON RELATED TO PENSION <br />OBLIGATIONS AND EMPLOYMENT RETIREMENT BENEFITS FOR PERSONNEL <br />ASSIGNED TO THE LIVERMORE-PLEASANTON FIRE DEPARTMENT JOINT <br />POWERS AUTHORITY <br />WHEREAS, the Livermore -Pleasanton Fire Department Joint Powers Authority ("LPFD <br />JPA") was formed as a separate entity in 1996 to provide fire protection services to Livermore <br />and Pleasanton; and <br />WHEREAS, the original LPFD JPA agreement was amended in 2000 to better define the <br />duties of the Fire Chief, roles of primary council, administrative services and other issues; and <br />WHEREAS, an Amended and Restated Agreement has been approved in 2018 to better <br />define the LPFD's duties, responsibilities, and powers, and the LPFD's relationship to the partner <br />cities; and <br />WHEREAS, a Memorandum of Understanding between Livermore and Pleasanton that <br />supports the Amended and Restated Agreement related to pension obligations and employment <br />retirement benefits has been drafted (Exhibit A); and <br />WHEREAS, staff recommends that the City Council authorize the City Manager to sign <br />the MOU. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />SECTION 1: Authorizes the City Manager to sign as provided in Exhibit A. <br />SECTION 2: This resolution shall become effective immediately upon its passage and <br />adoption and only at such time the Amended and Restated Agreement takes effect. <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a <br />regular meeting held on February 6, 2018. <br />I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br />resolution was adopted by the City Council at a regular meeting held on the 6th day of February <br />2018, by the following vote: <br />Ayes: <br />Noes: <br />Absent: <br />Abstain: <br />Karen Diaz, City Clerk <br />APPROVED AS TO FORM: <br />Daniel G.
