PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2010-03 <br />RESOLUTION DENYING CASE PAP -144, THE APPEAL OF PHIL BENZEL, ROBERT <br />MILLER, AND TODD BRIGGS, THEREBY UPHOLDING THE ZONING <br />ADMINISTRATOR'S DECISION APPROVING THE APPLICATION OF PONDEROSA <br />HOMES FOR DESIGN REVIEW APPROVAL, AS FILED UNDER CASE PDR -883 <br />WHEREAS, Ponderosa Homes has applied for Design Review approval to construct <br />an approximately 4,610 -square -foot two-story custom home at <br />6120 Sanctuary Lane (Lot 1, Tract 7162), within the Serenity at Callippe <br />development in the Happy Valley Specific Plan area; and <br />WHEREAS, zoning for the property is PUD-SRDR (Planned Unit Development — <br />Semi -Rural Density Residential) District; and <br />WHEREAS, on December 18, 2009, the Zoning Administrator approved the application <br />for Design Review; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Phil Benzel, <br />Robert Miller, and Todd Briggs appealed the Zoning Administrator's <br />decision to the Planning Commission; and <br />WHEREAS, at its duly noticed public hearings of February 24, 2010 and March 10, <br />2010, the Planning Commission considered all public testimony, relevant <br />exhibits, and recommendations of the City staff concerning this <br />application; and <br />WHEREAS, this project is categorically exempt from the requirements of the California <br />Environmental Quality Act (CEQA) by Guidelines Section 15303, Class 3 <br />(New Construction of Small Structures); additionally, an Environmental <br />Impact Report (EIR) was prepared and certified for the Happy Valley <br />Specific Plan, and CEQA specifies that residential development projects <br />(including residential planned unit developments) that are prepared <br />pursuant to the requirements of an adopted specific plan for which an EIR <br />has been prepared and certified are exempt from additional environmental <br />review; and <br />WHEREAS, the Planning Commission determined that the proposed project is <br />consistent with the appearance of the existing buildings in the area. <br />
