The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />The business operation as described in the applicant narrative is consistent and <br />compatible with other businesses in Valley Business Park. The size and operation <br />of the proposed use will not cause a parking impact since the suite has sufficient <br />parking spaces allocated to it and several unallocated parking spaces are also <br />located on the site. Further, the conditions of approval require the applicant to <br />mitigate potential nuisances that may arise with the proposed use or possible future <br />use. Therefore, this finding can be made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />The industrial zoning of Valley Business Park conditionally permits the establishment <br />of businesses engaged in construction related activities. Granting a conditional use <br />permit to Gorman Roofing for the proposed use would be consistent with the City's <br />ability to regulate land uses as prescribed by the zoning code. The proposed <br />conditions of approval will ensure that the applicable provisions of the PUD -1 zoning <br />are met. Therefore, this finding may be made. <br />WHEREAS, the Planning Commission determined that the proposed concrete floor <br />contracting business would be compatible with the existing uses in the <br />area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-262, the application of Gorman Roofing for a <br />Conditional Use Permit to transfer an existing Conditional Use Permit <br />(PCUP-189) for a roof contractor business from Suite 203 to Suite 202 of <br />the building located at 1040 Serpentine Lane, in the Valley Business Park, <br />subject to the conditions shown in Exhibit A, attached hereto and made <br />part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
