EXHIBIT A <br />CONDITIONS OF APPROVAL <br />PCUP-234, San Jose Arena Management <br />Staples Ranch <br />November 5, 2009 <br />The proposed sports bar on the second floor shall be operated in substantial <br />conformance to the plans dated "Received May 29, 2009," Exhibit B, except as <br />modified by the following conditions. Minor changes to the plans may be allowed <br />subject to the approval of the Director of Community Development if found to be <br />in substantial conformance to the approved exhibits, Exhibits A and B, inclusive. <br />2. Alcohol shall not be served between 1:00 a.m. and 10:00 a.m., unless otherwise <br />allowed in the Community Park Lease between the City of Pleasanton and San <br />Jose Arena Management. <br />3. The Ice Center operator shall obtain all necessary approvals from the <br />Department of Alcoholic Beverage Control (ABC) prior to, occupancy. <br />4. A full food service menu shall be available for patrons when alcohol is served. <br />5. Employees who serve alcohol shall undergo a training program such as TIPS <br />(Training for Intervention Procedures) that is designed to prevent intoxication, <br />underage drinking, and drunk driving. <br />6. No special promotions or advertising for alcohol shall be allowed outside of the <br />restaurant and sports bar area, unless otherwise allowed in the Community Park <br />Lease between the City of,Pleasanton and San Jose Arena Management. <br />7. If operation of this use results in any adverse impacts on'public health, safety or <br />general welfare, at the discretion of the Director of Community Development, this <br />Conditional Use Permit may be submitted to the Planning Commission for <br />subsequent review at a public hearing. If necessary, the Planning Commission <br />may modify or add conditions of approval to mitigate such impacts or may revoke <br />said Conditional Use Permit approval. <br />{end} <br />
