PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-40 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF SAN JOSE <br />ARENA MANAGEMENT FOR PLANNED UNIT DEVELOPMENT (PUD) <br />DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD -70 <br />WHEREAS, San Jose Arena Management has applied for Planned Unit Development <br />(PUD) development plan approval to establish allowed uses and the <br />construction of community park -related improvements, including an <br />approximately 141,679 -square -foot two-story ice-skating center with a pro <br />shop, restaurant with a bar, and related site improvements on 17 acres <br />located southwest of the intersection of 1-580 and EI Charro Road (Staples <br />Ranch); and <br />WHEREAS, at its duly noticed public hearing of November 5, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, an Environmental Impact Report (EIR) for the Staples Ranch project has <br />been certified by the City Council on February 24, 2009, and the potential <br />environmental impacts of this proposed project have been addressed in <br />that EIR, and no further environmental review is necessary; and <br />WHEREAS, the Planning Commission determined that the proposed development plan <br />is appropriate for the site; and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed development is in the best interests of the public <br />health, safety, and general welfare. <br />The project, as conditioned, will adhere to all applicable City standards <br />concerning public health, safety, and welfare. The subject development <br />will include the installation of all required site utilities with connections to <br />municipal systems in order to serve the project. The structures will be <br />designed to meet the requirements of the Uniform Building Code and Fire <br />Code. Two emergency vehicle access points will be provided, and the <br />proposed development, as conditioned, is compatible with adjacent uses. <br />The project, as conditioned, is in the best interest of the public health, <br />safety, and general welfare. Therefore, this finding can be made. <br />
