PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-37 <br />RESOLUTION RECOMMENDING DENIAL OF THE APPLICATION OF DON BABBITT/ <br />HEARTWOOD COMMUNITIES, FOR GENERAL PLAN AND HAPPY VALLEY SPECIFIC <br />PLAN AMENDMENT AND FOR PLANNED UNIT DEVELOPMENT REZONING AND <br />DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-75/PGPA-14/PSPA-3 <br />WHEREAS, Don Babbitt/Heartwood Communities has applied for a General Plan and <br />Happy Valley Specific Plan amendment and for Planned Unit <br />Development (PUD) rezoning and development plan approval for <br />additional lots over the allotted number for the 6.13 -acre parcel located at <br />1157 Happy Valley Road; and <br />WHEREAS, zoning for the property is PUD-SRDR (Planned Unit Development — <br />Semi -Rural Density Residential) District; and <br />WHEREAS, at its duly noticed public hearing of October 28, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the Environmental Impact Report (EIR) for the Happy Valley Specific Plan, <br />which was approved by the City Council on June 16, 1998, did not <br />assume increasing the density, such as that proposed, at the project site; <br />and <br />WHEREAS, the Planning Commission determined that the proposed project is not <br />consistent with the City's General Plan and the Happy Valley Specific <br />Plan, is not compatible with previously developed properties in the vicinity <br />and the natural topographic features of the site, and does not implement <br />the purposes of the City's PUD ordinance. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Recommends denial of Case PUD-75/PGPA-14/PSPA-3, the application <br />of Don Babbitt/Heartwood Communities for a General Plan and Happy <br />Valley Specific Plan amendment and for Planned Unit Development (PUD) <br />rezoning and development plan approval for additional lots over the <br />allotted number for the 6.13 -acre parcel located at 1157 Happy Valley <br />Road. <br />
