EXHIBIT A <br />CONDITIONS OF APPROVAL <br />PCUP-254, IvyMax, Inc. <br />5820 Stoneridge Mall Road, Suite 108 <br />October 14, 2009 <br />The location and operation of the proposed use shall conform substantially to <br />Exhibit B (site plan, floor plan, and written narrative), dated "Received, <br />September 11, 2009," on file with the Planning Division, except as modified by <br />the following conditions Iof approval. Minor changes to the approved operation <br />and schedule may be approved by the Director of Community Development if <br />found to be in substantial compliance with the proposal. <br />2. Students 12 years and under in age shall be signed in/out of the facility by their <br />parent/guardian and shall be accompanied by an adult to the restroom facilities. <br />3. The operation shall generally adhere to the schedule of activities, dated <br />"Received, September 11, 2009," found in Exhibit B. <br />Tutoring Hours: Tuesday — Friday 2:00 p.m. — 8:30 p.m. <br />Weekends 9:00 a.m. — 8:00 P.M. <br />The facility shall be allowed to open/close 30 minutes prior to and after sessions <br />for setup and cleanup. <br />4. If additional hours and activities beyond what was stated in the applicant's written <br />narrative and schedule of activities, dated "Received September 11, 2009," on <br />file in the Planning Division, are desired, prior City review and approval is <br />required. Such modification may be approved by the Director of Community <br />Development if found to be in substantial conformance with the approval. The <br />Director of Community Development may also refer the matter to the Planning <br />Commission if the proposed changes would be significant. <br />5. If the operation of this use results in conflicts pertaining to parking, interior noise, <br />traffic/circulation, or other factors, at the discretion of the Director of Community <br />Development, this Conditional Use Permit may be submitted to the Planning <br />Commission for their subsequent review at a public hearing. If necessary, the <br />Planning Commission may modify or add conditions of approval to mitigate such <br />impacts, or may revoke the said conditional use permit approval. Possible <br />mitigation measures may include, but are not limited to, modifying the hours of <br />operation, prohibiting amplified music, or other measures deemed necessary by <br />the Planning Commission. <br />
