The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. A condition of approval requires that children aged 12 years and under will be signed into and out of the facility by a parent or supervising adult. The subject site has adequate parking to support the proposed use, and it provides adequate and safe ingress and egress into and out of the site. As such, the proposed tutorial center would not be disruptive to or detrimentally impact surrounding uses. Therefore, this finding can be made. 3. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. The Pleasanton Municipal Code conditionally permits the establishment of a tutorial school within existing structures. Granting a Conditional Use Permit would be consistent with the City's ability to regulate the proposed use related to the applicable zoning provisions. The proposed facility, with conditions of approval, can be integrated into the surrounding properties without detrimentally affecting the surrounding properties or the City in general. Therefore, this finding can be made. WHEREAS, the Planning Commission determined that the proposed tutorial center would be compatible with the existing uses in the area. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case PCUP-254, the application of IvyMax, Inc. for a Conditional Use Permit to operate a tutoring center for students at 5820 Stoneridge Mall Road, Suite 108, subject to the conditions shown in Exhibit A, attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
