Resolution No. PC -2009-30 <br />Page Two <br />2. The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />A condition of approval requires that children 12 years and under will be signed into and <br />out of the facility by a parent or supervising adult. The building provides adequate <br />opportunity for both natural and artificial lighting, and the building's heating and <br />ventilation system will provide sufficient lighting and ventilation for the students. The <br />proposed operation is limited in scope, and the recommended conditions of approval <br />will ensure that the health, safety, and welfare of the students and surrounding <br />businesses will be maintained. Therefore, this finding can be made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />The industrial zoning of Valley Business Park conditionally permits the establishment of <br />indoor recreational and sports facilities. The proposed conditions of approval will <br />ensure that the applicable provisions of the PUD -1 zoning are met. Therefore, this <br />finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed recreational <br />facility would be compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-248, the application of Kevin Butler for a <br />Conditional Use Permit to operate a recreational facility at 1040 <br />Serpentine Lane; subject to the conditions shown in Exhibit A, attached <br />hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
