The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />As conditioned, the use would not be detrimental to the public health, safety, or welfare, <br />or materially injurious to properties or improvements in the vicinity. The subject site has <br />adequate parking to support the proposed use, and it provides adequate and safe <br />ingress and egress into and out of the site. As such, the proposed tutorial center would <br />not be disruptive or detrimentally impact surrounding uses. Therefore, this finding can <br />be made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />The PUD development plan and the Pleasanton Municipal Code conditionally permit the <br />establishment of a private/tutorial school within existing structures. Chapter 18.124 of <br />the Pleasanton Municipal Code (Conditional Uses) states that because of their unusual <br />characteristics, conditional uses require special consideration so that they may be <br />located properly with respect to their effects on the surrounding properties. Granting a <br />Conditional Use Permit would be consistent with the City's ability to regulate related <br />zoning regulations. The proposed tutorial center, as conditioned, can integrate the <br />tutorial center without detrimentally affecting the surrounding properties of the City in <br />general. Therefore, this finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed tutorial center <br />would be compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-252, the application of Louis Yihmin Liou, Summit <br />Tutoring Center, for a Conditional Use Permit to operate an academic and <br />music tutorial school for Grades 6 to 11 at 4430 Willow Road, Suite C, <br />subject to the conditions shown in Exhibit A, attached hereto and made <br />part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
