EXHIBIT A CONDITIONS OF APPROVAL PCUP-249, Joseph and Maricela Barone 475 St. John Street August 12, 2009 The approved activities/operation of Barone's Restaurant at 475 St. John Street are modified and shall conform substantially to Exhibit B (dated "Received" July 28, and August 5, 2009), on file with the Planning Division, except as modified by these conditions. Minor changes to the approved activities/operation may be approved by the Director of Community Development if determined to be in substantial conformance with the approved exhibits. 2. Except as noted below, the operation of the restaurant/bar shall be limited to the following hours: Monday through Thursday, 6:00 a.m. to 12:00 midnight; Fridays and Saturdays, 6:00 a.m. to 1:00 a.m.; and Sundays, 6:00 a.m. to 11:00 p.m. The restaurant/bar may remain open until 1:00 a.m. on March 17th (St. Patrick's Day), July 3rd, the Wednesday before Thanksgiving Day, December 23rd, and New Year's Eve each year. The outdoor music and entertainment approved by this conditional use permit modification shall cease at 9:00 p.m. for the front deck and 10:00 p.m. for the rear patio area. The outdoor music and entertainment and 6:00 a.m. openings shall be limited to six days a week of the applicants' choosing. The restaurant/bar employees shall not dispose of waste or recyclables in the trash enclosure area prior to 8:00 a.m. or after 10:00 p.m. 3. If additional hours of operation or activities beyond that proposed in the applicants' written narrative (dated "Received" August 5, 2009) or as modified by these conditions are desired, prior City review and approval is required. Except as noted below, the Director of Community Development may approve the modification or refer the matter to the Planning Commission if judged to be substantial. A future request to extend the outdoor music and 6:00 a.m. openings to seven days a week shall be subject to Planning Commission review at a public hearing. . 4. The applicants shall work with the Director of Community Development and Planning Division staff to select a means to monitor the noise between 9:00 p.m. and 10:00 p.m. with a recording device that will create a record and notify the Barones should the noise exceed 70 decibels (dBA). 5. Employees that serve alcohol shall undergo a training program, such as TIPS (Training for Intervention Procedures), designed to prevent intoxication, underage drinking, and drunk driving. 6. The applicants shall work with the Community Development Director to provide acceptable directional signage to the Barone's Restaurant parking lot.
