EXHIBIT A <br />CONDITIONS OF APPROVAL <br />PCUP-249, Joseph and Maricela Barone <br />475 St. John Street <br />August 12, 2009 <br />The approved activities/operation of Barone's Restaurant at 475 St. John Street are <br />modified and shall conform substantially to Exhibit B (dated "Received" July 28, and <br />August 5, 2009), on file with the Planning Division, except as modified by these <br />conditions. Minor changes to the approved activities/operation may be approved by <br />the Director of Community Development if determined to be in substantial <br />conformance with the approved exhibits. <br />2. Except as noted below, the operation of the restaurant/bar shall be limited to the <br />following hours: Monday through Thursday, 6:00 a.m. to 12:00 midnight; Fridays <br />and Saturdays, 6:00 a.m. to 1:00 a.m.; and Sundays, 6:00 a.m. to 11:00 p.m. The <br />restaurant/bar may remain open until 1:00 a.m. on March 17th (St. Patrick's Day), <br />July 3rd, the Wednesday before Thanksgiving Day, December 23rd, and New Year's <br />Eve each year. The outdoor music and entertainment approved by this conditional <br />use permit modification shall cease at 9:00 p.m. for the front deck and 10:00 p.m. <br />for the rear patio area. The outdoor music and entertainment and 6:00 a.m. <br />openings shall be limited to six days a week of the applicants' choosing. The <br />restaurant/bar employees shall not dispose of waste or recyclables in the trash <br />enclosure area prior to 8:00 a.m. or after 10:00 p.m. <br />3. If additional hours of operation or activities beyond that proposed in the applicants' <br />written narrative (dated "Received" August 5, 2009) or as modified by these <br />conditions are desired, prior City review and approval is required. Except as noted <br />below, the Director of Community Development may approve the modification or <br />refer the matter to the Planning Commission if judged to be substantial. A future <br />request to extend the outdoor music and 6:00 a.m. openings to seven days a week <br />shall be subject to Planning Commission review at a public hearing. . <br />4. The applicants shall work with the Director of Community Development and <br />Planning Division staff to select a means to monitor the noise between 9:00 p.m. <br />and 10:00 p.m. with a recording device that will create a record and notify the <br />Barones should the noise exceed 70 decibels (dBA). <br />5. Employees that serve alcohol shall undergo a training program, such as TIPS <br />(Training for Intervention Procedures), designed to prevent intoxication, underage <br />drinking, and drunk driving. <br />6. The applicants shall work with the Community Development Director to provide <br />acceptable directional signage to the Barone's Restaurant parking lot. <br />
