PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-26 <br />RESOLUTION APPROVING A MODIFICATION TO THE EXISTING CONDITIONAL <br />USE PERMIT FOR JOSEPH AND MARICELA BARONE, <br />AS FILED UNDER CASE PCUP-249 <br />WHEREAS, Joseph and Maricela Barone have applied to modify the existing <br />Conditional Use Permit (UP -88-25) for the operation of Barone's <br />Restaurant located at 475 St. John Street to allow outdoor music and <br />entertainment; and <br />WHEREAS, zoning for the property is C -C (Central Commercial) District and <br />Downtown Revitalization District; and <br />WHEREAS, at its duly noticed public hearing of August 12, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA) Guidelines, <br />Section 15301, Existing Facilities, Class 1; and <br />WHEREAS, the Planning Commission determined that, as conditioned, the proposed <br />modification to the existing Conditional Use Permit for the operation of <br />Barone's Restaurant to allow outdoor music and entertainment will be a <br />benefit to the Downtown and that measures are in place to protect the <br />surrounding uses from unreasonable impacts. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-249, the application of Joseph and Maricela <br />Barone to modify the existing Conditional Use Permit (UP -88-25) for the <br />operation of Barone's Restaurant located at 475 St. John Street to allow <br />outdoor music and entertainment; subject to the conditions shown in <br />Exhibit A, attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
