PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC -2009-26 RESOLUTION APPROVING A MODIFICATION TO THE EXISTING CONDITIONAL USE PERMIT FOR JOSEPH AND MARICELA BARONE, AS FILED UNDER CASE PCUP-249 WHEREAS, Joseph and Maricela Barone have applied to modify the existing Conditional Use Permit (UP -88-25) for the operation of Barone's Restaurant located at 475 St. John Street to allow outdoor music and entertainment; and WHEREAS, zoning for the property is C -C (Central Commercial) District and Downtown Revitalization District; and WHEREAS, at its duly noticed public hearing of August 12, 2009, the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff concerning this application; and WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA) Guidelines, Section 15301, Existing Facilities, Class 1; and WHEREAS, the Planning Commission determined that, as conditioned, the proposed modification to the existing Conditional Use Permit for the operation of Barone's Restaurant to allow outdoor music and entertainment will be a benefit to the Downtown and that measures are in place to protect the surrounding uses from unreasonable impacts. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case PCUP-249, the application of Joseph and Maricela Barone to modify the existing Conditional Use Permit (UP -88-25) for the operation of Barone's Restaurant located at 475 St. John Street to allow outdoor music and entertainment; subject to the conditions shown in Exhibit A, attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
