a high volume of heavy truck traffic related to the Quarry <br />Lands. <br />(iii.) All property owners shall attach the following rider to each deed <br />for any property within the Staples Ranch Site: <br />Grantee hereunder acknowledges and agrees that the subject <br />property is located in the vicinity of active and operating quarries <br />and processing facilities. Grantee also acknowledges that <br />quarry operations may result in airborne particulate matter, <br />bright lights, noise and vibration, unattractive visual appearance, <br />and heavy truck traffic on EI Charro Road and adjacent streets <br />and roadways within or outside the quarries. Grantee accepts <br />possible inconvenience of discomfort from any of the foregoing <br />and Grantee hereby acknowledges and agrees that no claim of <br />nuisance shall lie based on any of the foregoing. Grantee <br />hereby covenants to include this same paragraph, in its entirety, <br />in any subsequent deed by Grantee of all or any portion of the <br />subject property. Grantee further covenants to include this <br />same paragraph within any lease for all or any portion of the <br />subject property <br />D. Code, General Plan, and Permits <br />Attention Getting Devices. At no time shall balloons, banners, pennants, <br />or other attention getting devices be utilized on the site except as allowed by <br />Section 18.96.060.K of the Zoning Ordinance for grand openings or by <br />Section 18.116.040 of the Zoning Ordinance if approved as part of a <br />temporary conditional use permit. At no time shall spot lighting be used in <br />conjunction with such grand openings and/or promotional events. <br />2. Grand Openings. Temporary signs, banners, pennants, and decorations <br />shall be allowed subject to the requirements of Section 18.96.060.K of the <br />Pleasanton Municipal Code. <br />3. Noise. Except as otherwise modified by the conditions of approval for this <br />case, compliance with the City's noise standards shall be achieved. <br />4. Airport Protection Area Boundary. Dwelling units shall not be located <br />east of the Airport Protection Area (APA) line for the Livermore Municipal <br />Airport adopted by the Alameda County Airport Land Use Commission in <br />1993. Prior to the issuance of a building permit, the project developer shall <br />revise the plans and draw the APA line on the site plan. <br />5. Prior to occupancy, the property owner shall meet with the Fire Marshal, or <br />his or her designee, about the Del Valle Dam evacuation system, in the <br />23 <br />
