EXHIBIT A <br />CONDITIONS OF APPROVAL <br />PCUP-239, Valley Community Church <br />Shining Light Preschool <br />4455 Del Valle Parkway <br />April 29, 2009 <br />The location and operation of the proposed uses conducted at the site shall <br />substantially conform to Exhibit B (dated April 22, 2009), on file with the Planning <br />Division, except as modified by the following conditions. Minor changes to the <br />exhibits may be allowed subject to the approval of the Director of Community <br />Development if found to be in substantial conformance to the approved exhibits. <br />2. If the operation of this use results in conflicts pertaining to parking, noise, traffic, <br />or other impacts, at the discretion of the Director of Community Development, <br />this conditional use permit may be referred to the Planning Commission for <br />subsequent review at a public hearing. If necessary, the Planning Commission <br />may modify or add conditions of approval to mitigate such impacts, or may <br />revoke said conditional use permit. <br />3. If additional hours of operation or activities beyond that proposed in the <br />applicant's written narrative, dated "Received April 22, 2009," on file with the <br />Planning Division, are desired, prior City review and approval is required. The <br />Director of Community Development may approve the modification or refer the <br />matter to the Planning Commission if judged to be substantial. <br />4. All uses at the subject site shall conform to the City Noise Ordinance standards <br />and General Plan noise policies. <br />5. The applicant shall obtain State license approval for additional children prior to <br />commencing enrollment for the school year session and provide proof of the <br />revised license prior to Fall 2009 enrollment. The operator/director of the <br />preschool shall ensure that the State license is current and that all State licensing <br />requirements are met at all times. The facility shall enroll only the number of <br />children for which it has a State license. <br />6. Preschool children shall be escorted into and out of the facility and signed in and <br />out by a parent or supervising adult. <br />7. Except as modified by this resolution, all conditions of approval of the previous <br />conditional use permit approvals (UP -98-20 and PCUP-25) shall remain in full <br />force and effect. <br />
