The proposed location of the conditional use and the conditions <br />under which the conditional uses would be operated or maintained <br />will not be detrimental to the public health, safety, or welfare, or <br />materially injurious to the properties or improvements in the vicinity. <br />The serving of alcoholic beverages has been conditioned to adhere to all <br />requirements of the Alcohol and Beverage Control agency. A condition of <br />approval has been added to allow the review and possible revocation of <br />this use permit should there be any averse impacts on the public health, <br />safety, and general welfare. <br />3. The proposed conditional use will comply with each of the <br />applicable provisions of the Zoning Ordinance. <br />Based on the proposal and the analysis of this proposed used, the <br />granting of a conditional use permit to the proposed use would be <br />consistent with the City's ability to regulate zoning regulations. Therefore, <br />this finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed project is <br />consistent with the appearance of the existing buildings in the area, and <br />the conditional use would be compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PDR-804/PCUP-233, the application of Tom Kubo/William <br />Wood Architects, Hana Japan, for Design Review approval to construct an <br />approximately 6,000 -square -foot building at 11991 Dublin Canyon Road <br />for Hana Japan Steak House and for a Conditional Use Permit to serve <br />alcoholic beverages after 10:00 p.m., subject to the conditions shown in <br />Exhibit A-1 for the Design Review approval and Exhibit A-2 for the <br />Conditional Use Permit, attached hereto and made part of this case by <br />reference. <br />Section 2. This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
