The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />Given the large number of parking spaces for the building, the availability of ample <br />on -street parking, and the small demand for parking that the proposed use would <br />generate during normal business hours, the music studio has adequate parking to meet <br />the demand and does not adversely impact the adjacent tenants. <br />The parking court provides direct access to each tenant suite, and this suite also has <br />direct access from on -street parking. Thus, operation of each business should not <br />interfere with one another, and the exchange of students will not be across adjacent <br />tenant spaces. <br />The streets leading to the site are designed per City standards and are signalized to <br />provide safe access into and out of the site. Any areas of possible concern have been <br />conditioned so that the proposed use would meet all applicable Municipal Code <br />requirements and would be operated in a non -nuisance manner. Furthermore, the <br />applicant can be required to mitigate any further nuisances or problems. Therefore, this <br />finding can be made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />The existing Conditional Use Permit (PCUP-154) was found to comply with all relevant <br />sections of the Zoning Ordinance. Based on the proposal for expansion of the existing <br />use, the proposed modifications are consistent with the original approval and the City's <br />ability to regulate related zoning regulations. Therefore, this finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use <br />would be compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-237, the application of Rimma Radayeva, <br />Radayeva Music Studio, to modify a previously approved Conditional Use <br />Permit for Radayeva Music Studio located at 1228 Quarry Lane, Suite A, <br />to increase the number of instrument and vocal instructors from one to five <br />at any onetime and to extend the hours of operation from 10:00 a.m.- <br />9:00 p.m. to 10:00 a.m.-9:30 p.m., subject to the conditions shown in <br />Exhibit A, attached hereto and made part of this case by reference. <br />
