PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-02 <br />RESOLUTION RECOMMENDING APPROVAL OF A NEGATIVE DECLARATION FOR <br />THE APPLICATION OF DUTRA TRUST, AS FILED UNDER CASE PUD -77 <br />WHEREAS, Dutra Trust has applied for Planned Unit Development (PUD) <br />development plan approval to subdivide a ten -acre site located at <br />1053 Happy Valley Road into five single-family residential lots and one <br />open space parcel; and <br />WHEREAS, the Planning Commission received and reviewed the Initial Study, dated <br />November 7, 2008 and received the recommendation of staff; and <br />WHEREAS, at its meeting of January 14, 2009, the Planning Commission received a <br />proposed Negative Declaration for Case PUD -77; and <br />WHEREAS, the public was given the opportunity to comment on the environmental <br />impacts of the proposal; and <br />WHEREAS, the Planning Commission has reviewed the potential impacts in <br />accordance with the applicable State and local guidelines governing the <br />preparation of Negative Declarations; and <br />WHEREAS, the Planning Commission finds that approval of the proposed project <br />would not have any significant adverse effects on the site's wildlife. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of the Negative Declaration prepared for <br />Case PUD -77, the application of Dutra Trust for Planned Unit <br />Development (PUD) development plan approval to subdivide a ten -acre <br />site located at 1053 Happy Valley Road into five single-family residential <br />lots and one open space parcel. <br />Section 2. Finds that the proposed project will not have any significant adverse <br />effects on the site's wildlife. <br />Section 3. This resolution shall become effective immediately upon its passage and <br />adoption. <br />
