Resolution No. PC -2009-01
Page Three
6. The design of the subdivision or type of improvements is not likely
to cause serious public health problems.
The subdivision is designed to be served by all City utilities and serviced
at established service levels in that full water and sewer services are
provided. Therefore, this finding can be made.
7. The design of the subdivision or the type of improvements does not
conflict with easements for access through, or use of, the property.
There are no existing easements for access or use through the property,
and the approved development plan provides proper access and
easements to the new parcels. Therefore, this finding can be made.
8. The restriction approving a tentative subdivision map on land
covered by a contract entered into pursuant to the California Land
Conservation Act of 1965 (Williamson Act) is not applicable.
The site is not covered by such a contract. Therefore, this finding can be
made.
9. The discharge of waste from the proposed subdivision would not
result in violation of existing requirements prescribed by the
California Regional Water Quality Control Board.
The project will meet all State and local ordinances and requirements,
including those of the California Regional Water Control Board.
Therefore, this finding can be made.
WHEREAS, the Planning Commission has determined that the proposed subdivision is
in keeping with the requirements of the previously approved PUD
development plan.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
PLEASANTON RESOLVES THE FOLLOWING:
Section 1. Approves Vesting Tentative Tract Map 7952, the application of Jerry
Raney for Vesting Tentative Tract Map approval to merge and
re -subdivide two existing parcels totaling approximately .51 -acre located
at 4693 and 4715 Augustine Street into six new parcels ranging in size
from 3,150 square feet to 4,320 square feet, subject to the conditions
shown in Exhibit B, attached hereto and made part of this case by
