PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-48 <br />RESOLUTION UPHOLDING THE APPEAL OF PHIL BLANK, PAP -126, THEREBY <br />OVERTURNING THE ZONING ADMINISTRATOR'S DECISION AND DENYING THE <br />APPLICATION OF KELLY PEPPER/TOWN CONSULTING, FOR T -MOBILE FOR <br />DESIGN REVIEW, AS FILED UNDER CASE PDRW-6 <br />WHEREAS, Kelly Pepper/Town Consulting, for T -Mobile, applied for design review <br />approval to redesign the existing tower at the existing McDonald's building <br />located at 3001 Bernal Avenue to house a wireless facility for T -Mobile; <br />and <br />WHEREAS, zoning for the property is PUD -C (Planned Unit Development — <br />Commercial) District; and <br />WHEREAS, on September 2, 2008, the Zoning Administrator approved the application <br />for design review; and <br />WHEREAS, on September 8, 2008, Phil Blank appealed the Zoning Administrator's <br />decision to the Planning Commission; and <br />WHEREAS, at its duly noticed public hearing of September 24, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, this project is categorically exempt from environmental review pursuant to <br />California Environmental Quality Act Guidelines, Section 15301(a); and <br />WHEREAS, the Planning Commission determined that based on the provisions of the <br />City's Personal Wireless Service Facility Ordinance, the proposed project <br />would limit the uses in the adjacent vacant lot. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Upholds Case PAP -126, the appeal of Phil Blank, thereby overturning the <br />Zoning Administrator's decision and denying the application of Kelly <br />Pepper/Town Consulting for design review to redesign the existing tower <br />at the existing McDonald's building located at 3001 Bernal Avenue to <br />house a wireless facility for T -Mobile. <br />
