Resolution No. PC -2008-09 <br />Page Two <br />2. The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />The World School of Massage has been in operation since September 2004. To date, <br />no complaints have been received regarding its operation. The proposed student clinic <br />is proposed to be a part of the school curriculum. Thus, adding this new activity to the <br />school's curriculum would not impact the adjacent business's ability to operate. <br />As proposed, the student clinic would be held within the regular schools hours, and <br />students would be required to meet the requirements of the City's Massage Ordinance <br />before they are allowed to work in the clinic as well as to be students of the school itself. <br />In addition, an existing parking lot is located to the immediate north of the subject lot. <br />Curbside parking on Peters Avenue and other nearby public streets is also available. <br />Therefore, this finding can be made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />Based on the proposal and the analysis on land use, noise, and parking, the granting of <br />a Conditional Use Permit for the proposed use would be consistent with the City's ability <br />to regulate related zoning regulations. Therefore, this finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use <br />would be compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-213, the application of Patricia Cramer for a <br />Conditional Use Permit to amend the previously approved Conditional Use <br />Permit (PCUP-128) to allow a student clinic as part of the curriculum for <br />the massage school located at 699 Peters Avenue, Suite A, subject to the <br />conditions shown in Exhibit B, attached hereto and made part of this case <br />by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
