PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-03 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR <br />SYLVAN LEARNING CENTER, AS FILED UNDER CASE PCUP-207 <br />WHEREAS, Sylvan Learning Center has applied for a Conditional Use Permit to <br />operate a tutoring center for more than 20 students at an existing building <br />located at 6654 Koll Center Parkway, Suite 185; and <br />WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development — <br />Industrial/Commercial-Office) District; and <br />WHEREAS, at its duly noticed public hearing of January 23, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, existing facilities consisting of the operation, permitting, licensing, or minor <br />alteration of structures involving no expansion of use beyond that existing <br />are categorically exempt from environmental review pursuant to California <br />Environmental Quality Act (CEQA) Guidelines, Section 15301, Existing <br />Facilities, Class 1 (E)(2)(A); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is <br />located. <br />The objectives of the zoning ordinance include fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from inharmonious <br />influences and harmful intrusions; and ensuring that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The proposed learning center would provide instruction to local children. The <br />City has allowed similar uses to be located in office, industrial, and commercial areas. <br />None of these teaching -oriented businesses has created any impacts on surrounding <br />businesses. <br />The subject site is zoned PUD-I/C-O (Planned Unit Development — Industrial/ <br />Commercial -Office) District, where a mix of office/commercial/personal service uses <br />surrounds it.
