(a) Owner shall pay applicable water and/or sanitary sewer connection fees. <br /> (b) Owner shall connect to City water service and/or City sanitary sewer <br /> service in a manner consistent with City standards in the determination of <br /> the City Engineer or his or her designee. <br /> (c) Owner shall abandon any septic system on the property if connecting to <br /> City sanitary sewer service. <br /> (d) Owner shall pay pro-rata share of previously constructed City water and/ <br /> or City sanitary sewer infrastructure in Happy Valley. <br /> (e) Owner shall pay pro-rata share of future frontage improvements along the <br /> Property if the County or City in the future undertake public street frontage <br /> improvements including, but not limited to, curb, gutter/storm drain <br /> system, sidewalk, street lights, etc.). <br /> (f) Owner shall pay all City and County processing fees and water and/or <br /> sewer connection is subject to Alameda County Local Agency Formation <br /> Commission (LAFCo) and Livermore-Amador Valley Water Management <br /> Agency (LAVWMA) approval. <br /> (g) Owner shall obtain City design review approval for a future residence and ' <br /> any future addition or alteration to the property requiring a building permit <br /> from the County. <br /> (h) Owner shall agree to not subdivide the subject property. <br /> (i) Owner shall agree to support any subsequent annexation initiative that <br /> may occur. <br /> 2. Agreement to Annex. Owner shall consent to annexation of the Property to <br /> the City of Pleasanton at such time as the City may require. This Agreement, State <br /> and County laws, and City ordinances and resolutions shall control the <br /> responsibilities of both parties at the time of annexation. Owner shall cooperate with <br /> City in the annexation of the Property, whether as part of a larger area or as part of a <br /> smaller area; Owner expressly waives the right to protest said annexation and shall <br /> agree to do no act calculated or tending to prevent, impede, or defeat the successful <br /> annexation of the Property. More specifically, by signing this Agreement, Owner <br /> acknowledges and agrees that if any annexation is subject to an election, the Owner <br /> deems Owner's vote is counted as a vote in favor of annexation. <br /> 3. No Further Subdivision. Owner shall not subdivide the Property without <br /> the prior approval of the City. <br />
