Staff has concluded that the City <br /> Council's previous approvals of the Development Agreement for the Stoneridge Mall are <br /> still advantageous for the City. If the extension is approved by the City Council, the <br /> development rights and responsibilities described in the previous Development <br /> Agreements for the Mall will remain in effect to December 31, 2022, therefore, enabling <br /> Stoneridge Properties to proceed with the expansion of the Stoneridge Mall and allow it <br /> to remain competitive in the current retail environment. <br /> PUBLIC NOTICE <br /> Notice of this hearing was sent to all property owners and tenants/occupants within <br /> 1,000 feet of the subject properties as shown in Attachment 4. Staff has not received <br /> any verbal or written communications about the proposal as of the publication of this <br /> staff report. Any public comments or concerns will be forwarded to the City Council. <br /> ENVIRONMENTAL ASSESSMENT <br /> The original Development Agreement was the subject of a Mitigated Negative <br /> Declaration and Initial Study approved by the City Council on November 1996 in <br /> compliance with CEQA. <br /> The Initial Study that accompanied the Mitigated Negative Declaration included traffic <br /> analyses which determined the shopping center's traffic with the expansion will occur <br /> primarily off-peak and, therefore, would not impact surrounding streets and intersections <br /> during the critical a.m./p.m. peak-commute hours. Staff notes the traffic resulting from <br /> the remaining permitted floor area of 362,790 square feet was also addressed in the <br /> General Plan EIR and Housing Element and Climate Action Plan General Plan <br /> Amendment and Rezonings Supplemental EIR, confirming the conclusions of the <br /> original analysis. <br /> The environmental effects of the project were reviewed as part of the Initial Study and <br /> Mitigated Negative Declaration as well as the Supplemental Environmental Impact <br /> Report SEIR) and adopted the CEQA Findings and a Statement of Overriding <br /> Considerations for the Housing Element and Climate Action Plan General Plan <br /> Amendment and Rezonings Supplemental EIR which were adopted pursuant to <br /> California Environmental Quality Act (CEQA). As the physical environment has not <br /> significantly changed since that time, and the Development Agreement to vest the <br /> entitlement for an additional five years does not modify the project, no further <br /> environmental document accompanies the consideration of this Development <br /> Agreement.
