The proposed conditions of approval for the <br />project give the City the appropriate controls to ensure that the use does <br />not have any negative impacts on the surrounding businesses and <br />properties. <br /> <br />2. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Given the proposed occupancy and hours of operation for the subject use, <br />the proposed use will have adequate off-street parking to meet project <br />demand and would not adversely impact the adjacent tenants. The <br />proposed use is to be operated entirely indoors and activities should not <br />interfere with adjacent uses. Interior space improvements will be in <br />accordance with the City's Building Code. Streets leading to the site are <br />designed per City standards and are signalized to provide safe access into <br />and out of the site. Any areas of possible concern have been conditioned <br />so that the proposed use will meet all applicable Municipal Code <br />requirements and would be operated in a non-nuisance manner. <br /> <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br /> <br />The proposed use will comply with all provisions and requirements of the <br />City's zoning ordinance. Granting a conditional use permit to Sylvan <br />Learning Center is consistent with the City's ability to regulate zoning as <br />listed in the Municipal Code Chapter 18.124 "Conditional Uses." <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, <br />would be compatible with the surrounding businesses and will not detrimentally <br />affect the surrounding uses or properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Approves Case UP-98-66, the application of Sylvan Learning Center for a <br />conditional use permit to allow a supplementary educational instruction facility <br />for children and teens to be located within an existing building located at 3003 <br />Hopyard Road, Suite A (Hopyard Village Shopping Center, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br />
