12. No building permit shall be issued or lot sold for any of the new homes within this project until after the new elementary and middle schools, anticipated to be open by fall, 2000, are operational, except that a building permit may be issued for Lot 4 to the owner who will occupy the home. The Phoebe Apperson Hearst School shall be open prior to the owner occupancy of the dwelling on Lot 4. 13. Lots #2 and #3 shall be subject to the uses ofthe R-I-20,000 zoning district and Lots #4 and #1 shall be subject to the uses ofthe R-I-40,000 zoning district, except as modified by the design guidelines. 14. The applicant shall comply with the recommendations of the geotechnical report prepared by Terrasearch dated September 3,1996. The applicant's geotechnical consultant shall review and approve all foundation, retaining wall, and drainage geotechnical aspects of the final development plans to ensure that the recommendations have been properly incorporated into the development. The consultant shall certify by writing on the plans or as otherwise acceptable to the Director of Building Inspection that the final development plan is in conformance with the geotechnical report approved with the project. 15. The applicant shall provide all buyers with copies of the project conditions of approval and design guidelines. Reference to the conditions and design guidelines shall be made in the deed for the properties, subject to the approval of the City Attorney. 16. All site improvements and construction activities shall be limited to the hours of 8:00 a.m. to 5:00 p.m., Monday through Saturday, excluding Federal holidays, while the Greenbriar project is under construction. When the Greenbriar project is completed, the construction hours shall be 8:00 a.m. to 5:00 p.m., Monday through Friday, excluding Federal holidays. Interior improvements may be constructed during other hours if approved by the Planning Director. All construction equipment must meet DMV noise standards and shall be equipped with muffling devices. 17. At no time shall campers, trailers, motor homes, or any other vehicle be used as living or sleeping quarters on the construction site. All such vehicles shall be removed from the site at the end of each work day. 18. All trees used in landscaping be a minimum of 15 gallons in size and all shrubs a minimum of 5 gallons, unless otherwise shown on the approved landscape plan or required in other conditions of approval or the design guidelines.
