The location and operation of the proposed use shall conform substantially to <br />Exhibit A (the site plan, floor plan, and details of operation), dated "Received" <br />July 2, 1999, on file with the Planning Department, except as modified by these <br />conditions. <br /> <br />2. The applicants shall contact the Building, Police, Fire, and County Environmental <br />Health Departments to determine all applicable requirements. The structure must <br />be made to conform with all applicable occupancy requirements, codes, and <br />ordinances. All future tenant improvements shall be included as part of this <br />condition. <br /> <br />3. The applicants shall obtain all building and other applicable City permits for the <br />tenant improvements prior to the commencement of construction. <br /> <br />4. The operation of the restaurant shall be limited to the following hours: 10:00 a.m. <br />to 10:00 p.m., Monday through Friday, and 10:00 a.m. to 11:00 p.m., Saturday and <br />Sunday. <br /> <br />5. In the event that the applicants propose to modifY the hours or other aspects of the <br />business operation the modification shall be subject to the review of the Planning <br />Director. The Planning Director may approve the modification or refer the matter <br />to the Planning Commission if judged to be substantial. <br /> <br />6. If operation of this use results in conflicts pertaining to parking, interior or exterior <br />noise, traffic/circulation, litter, odors, loitering, fighting, or other factors, at the <br />discretion on the Planning Director, this conditional use permit may be submitted <br />to the Planning Commission for their subsequent review at a public hearing. If <br />necessary, the Commission may modifY or add conditions of approval to mitigate <br />such impacts, or may revoke said conditional use permit. <br /> <br />7. The applicants (or designated representative of the business) shall maintain the <br />area around the building in which the proposed restaurant will be located in a clean <br />and orderly manner at all times. The management of the restaurant shall also be <br />responsible for retrieving stray litter generated by this use that may be scattered in <br />other areas of the center, the adjacent driveway, and sidewalk area. <br />
