<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-53 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF JOSEPH AND MARIE <br />GHIRINGHELLI TO MODIFY A CONDITIo"OF APPROVAL OF TRACT 5835 <br />(VINTAGE HEIGHTS II) AND FOR DESIGN REVIEW APPROVAL, AS FILED <br />UNDER CASE Z-99-185 <br /> <br />WHEREAS, Joseph and Marie Ghiringhelli have applied to modifY a condition of approval of <br />Tract 5835 (Vintage Heights II) and for design review approval to allow the <br />construction of a ten-foot high, open patio cover 25.5 feet from the rear property <br />line where 40 feet is the required rear yard setback for the existing residence <br />located at 2932 Amoroso Court; and <br /> <br />WHEREAS, zoning for the property is R-I-6500 (Single-Family Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of August 11, 1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission determined that the existing screening meets the intent <br />of the tract map conditions of approval to reduce the impact of new construction <br />on the downhill Vintage Hills residents and that the proposed patio cover is <br />attractively designed. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves the application of Joseph and Marie Ghiringhelli to modify a condition <br />of approval of Tract 5835 (Vintage Heights II) and for design review approval to <br />allow the construction of a ten-foot high, open patio cover 25.5 feet from the rear <br />property line where 40 feet is the required rear yard setback for the existing <br />residence located at 2932 Amoroso Court, subject to the conditions shown in <br />Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
