The use shall substantially conform to the site plan, floor plan, and narrative, Exhibit "A", <br />dated "Received June 14, 1999" on file with the Planning Department, except as modified <br />by the following conditions. Minor changes to the plans may be allowed subject to the <br />approval of the Planning Director if found to be in substantial conformance to the <br />approved exhibits. <br /> <br />2. Classes shall conducted between the hours 8 AM to 8 PM, Sunday through Saturday. <br /> <br />3. The total number of students being tutored inside the tenant space shall not exceed 27. <br /> <br />4. If additional activities, additional students or staff members beyond that initially <br />proposed, or modifications to the hours of operation are desired, prior City review and <br />approval is required. Such modifications shall be submitted to the Planning Director, <br />who may approve the modification or refer the matter to the Planning Commission if <br />judged to be substantial. <br /> <br />5. rfthe operation of the use results in major conflicts pertaining to parking, noise, traffic, <br />or other impacts, at the discretion of the Planning Director, this conditional use permit <br />may be referred to the Planning Commission for subsequent review at a public hearing. <br />If necessary, the Commission may modify or add conditions of approval to mitigate such <br />impact, or may revoke said conditional use permit. <br /> <br />6. Signage for the proposed use shall conform to the approved Oak Hills Shopping Center <br />sign program and shall be submitted for review and approval by the Planning and <br />Building Department prior to installation. <br /> <br />7. The applicant shall obtain all building and other applicable City permits for the project <br />prior to the commencement of the use. <br /> <br />8. Ifthe operation of the tutoring service results in complaints regarding noise from <br />neighboring tenants or residents, the applicant shall work with staff to reduce noise levels <br />and associated impacts to an acceptable level. Ifthe noise issue cannot be resolved, the <br />Planning Director shall refer the use permit to the Planning Commission for review at a <br />public hearing. <br /> <br />{ end} <br />
