<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-89 <br /> <br />RESOLUTION DENYING THE APPLICATION OF PETER SHUTTS/RUSS <br />MORGAN, AS FILED UNDER CASE UP-98-37/Z-98-176 <br /> <br />WHEREAS, Peter Shutts/Russ Morgan have applied for design review and conditional use <br />permit approvals to allow a rental yard, outdoor storage, and accessory uses; and <br />to allow the placement of five modular buildings and 14 shipping containers on <br />site; and to allow the construction of a patio cover, a new business sign, and the <br />repainting of an existing building located at 3878 Stanley Boulevard; and <br /> <br />WHEREAS, zoning for the property is C-S (Service Commercial) District; and <br /> <br />WHEREAS, <br /> <br />at its duly noticed public hearing of November <br />Commission considered all public testimony, <br />recommendations of the City staff; and <br /> <br />23, 1998, the Planning <br />relevant exhibits, and <br /> <br />WHEREAS, the Planning Commission determined that the proposed operation will not be <br />compatible with surrounding properties and that the use does not meet the intent <br />of the Zoning Ordinance and may impact the public health, safety, and general <br />welfare. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies the application of Peter Shutts/Russ Morgan for design review and <br />conditional use permit approvals to allow a rental yard, outdoor storage, and <br />accessory uses; and to allow the placement of five modular buildings and 14 <br />shipping containers on site; and to allow the construction of a patio cover, a new <br />business sign, and the repainting of an existing building located at 3878 Stanley <br />Boulevard. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
