<br />Resolution No. PC-98-87 <br />Page 4 <br /> <br />EXHIBIT "B" <br />PLANNING COMMISSION <br />CONDITIONS OF APPROVAL <br />UP-98-019 - GREENBRIAR SYCAMORE VALLEY COMPANY <br />DETACHED SECOND-UNIT APPROVAL <br /> <br />1. Development shall be substantially as shown on the floor plan, site plan, and <br />elevations, Exhibit "A", dated "Received April 1, 1998" on file with the Planning <br />Department, except as modified by the following conditions. Minor changes to the <br />plans may be allowed subject to the approval ofthe Planning Director if found to <br />be in substantial conformance to the approved exhibits. <br /> <br />2. Only one second-unit is allowed on any lot. <br /> <br />3. No detached second-units may be constructed on those lots which are adjacent to <br />the existing lots located to the north (Lots #4-#7, #11-#13, and #19-#28). In <br />addition, no two lots adjacent to each other shall have a detached second unit. <br /> <br />4. The rear yard setback for the PUD-LDR lots shall be ten (10) feet and the side yard <br />setback shall be five (5) feet. The rear and side yard setbacks for the PUD-A lots <br />shall be twenty (20) feet. The maximum height shall be fifteen feet. <br /> <br />5. Only one residential unit on any property with a primary and secondary residence <br />may be rented. The other unit shall be owner-occupied. A second-unit shall be <br />occupied by no more than two adults, although there shall be no limit on the <br />number of children. The developer shall indicate this condition in written form on <br />a deed restriction to any buyer who has selected a second-unit option, and the <br />language of this deed restriction shall be submitted to the City Attorney for review <br />and approval prior to the issuance of building permits for any residence. <br /> <br />6. In no case shall any second-unit be sold, subdivided, or held under different legal <br />ownership from the primary residence. The developer shall indicate this condition <br />in written form as a deed restriction to any buyer who has selected a second-unit <br />option. The language of this deed restriction shall be submitted to the City <br />Attorney for review and approval prior to the issuance of building permits for any <br />residence. <br />
