<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-82 <br /> <br />RESOLUTION DENYING THE APPEAL OF NEIL AND PATRICIA NELSON OF <br />AN ADMINISTRATIVE DETERMINATION, AS FILED UNDER CASE AP-98-14 <br /> <br />WHEREAS, Neil and Patricia Nelson have received design review approval to construct a <br />custom home located at 8088 Bethel Lane; and <br /> <br />WHEREAS, zoning for the property is R-I-40,OOO (Single-Family Residential - 40,000 square <br />foot minimum lot size), West Foothill Road Corridor Overlay District; and <br /> <br />WHEREAS, conditions of approval for the design review included a number of conditions <br />which required that the specific access and infrastructure details would be <br />provided by the applicant prior to building permit issuance; and <br /> <br />WHEREAS, following approval, the applicants proposed modifications to the design of the <br />home, which were agreed to by staff with the stipulation that the applicant would <br />compensate for the impacts of the modified design by darkening the exterior <br />stucco color of the home; and <br /> <br />WHEREAS, staff has determined that the design of the storm drainage system is inadequate <br />and does not meet the conditions of approval and that the applied color is too light <br />and does not meet the conditions of approval; and <br /> <br />WHEREAS, the applicants have appealed staffs determination to the Planning Commission; <br />and <br /> <br />WHEREAS, at its duly noticed public hearing of October 28, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff; and <br /> <br />WHEREAS, the Planning Commission determined that the raised drainage ditch and the <br />applied stucco color have not satisfied the conditions of approval. <br />
