<br />Resolution No. PC-98-76 <br />Page 2 <br /> <br />As proposed, the proposed building entrance and walkway would not detract from <br />the building's architectural and landscape features. In addition, the school use will <br />not interfere with surrounding uses' ability to operate. The anticipated number of <br />employees and students will not generate any unusual demands on existing <br />parking for the building or the surrounding properties. As conditioned, the <br />proposed use will be compatible with adjacent office uses located within the <br />building, and with the office, medical, and residential uses located on the <br />surrounding parcels. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The proposed college will be contained completely within the building on the site. <br />Sufficient parking, adequate separation from the residential neighborhoods, and <br />maintenance of noise levels have been provided or conditioned. All streets <br />around the site are designed per City standards to provide safe ingress and egress <br />into and out of the site. As conditioned, the proposed operation of the school <br />would meet the occupancy and other requirements of the Pleasanton Municipal <br />Code, Fire Code, and Uniform Building Code. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />The site's C-R-P zoning conditionally permits the establishment of business and <br />trade schools. In addition, the proposed use complies with all relevant sections of <br />the zoning ordinance. Granting a conditional use permit to the University of <br />Phoenix would be consistent with the City's ability to regulate zoning as listed in <br />the Municipal Code Chapter 18.124. <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with surrounding uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-98-60, the application ofthe University of Phoenix for a <br />conditional use permit to operate a post -secondary school in an existing office <br />building located at 790 I Stoneridge Drive, Suite 100, subject to the conditions <br />shown in Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
