<br />Exhibit B: <br />Conditions of Approval for PUD 96-14 <br />Merritt Property <br />September 23, 1998 <br />Planning Commission <br /> <br />Planninl! <br /> <br />I. Development shall be substantially as shown on the development plans, Exhibit A, <br />dated "Received September 2, 1998" on file with the Planning Department, except <br />as modified by the following conditions. Minor changes to the plans may be <br />allowed subject to the approval of the Planning Director if found to be in <br />substantial conformance to the approved exhibits. <br /> <br />2. This PUD shall be subject to the permitted and conditional uses of the R-l zoning <br />district. <br /> <br />3. Approval of this PUD shall not take effect until the recording of the annexation <br />map and description by LAFCO. <br /> <br />4. In the event the property tax-sharing agreement negotiated for the City during the <br />annexation of the project results in the city receiving less than the current average <br />share of property tax, the applicant shall work with the City to make up the <br />shortfall on a permanent basis. <br /> <br />5. The existing manufacturing operations shall cease operation upon recordation of <br />the annexation for this property. All hazardous materials used for this <br />manufacturing process shall be removed from the site at this time in accordance <br />with the applicable City and State Codes. The City Fire Marshall shall inspect the <br />site to determine whether this has been completed and shall submit a report <br />certifYing that this has been completed to the Planning Director prior to the <br />issuance of a building permit. <br /> <br />6. Prior to recordation of the final map, all modifications required to the design <br />guidelines by these conditions of approval shall be combined into a single <br />comprehensive document.
