The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />As conditioned, the cabinet shop would be subject to the regulations of the City <br />Building and Fire Codes, no construction activities would take place outside of <br />the tenant suite, and all doors must remain closed when machinery is in use. If <br />any complaints about equipment noise are received in the future, the owner of the <br />woodworking/cabinet shop would have to mitigate the noise (e.g. install <br />additional noise muffling material in the walls). The amount of off-street <br />parking reserved on the site for the subject use meets Municipal Code <br />requirements. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />Chapter 18.124 of the Zoning Ordinance states that, because of their unusual <br />characteristics, conditional uses require special consideration so that they may be <br />located properly with respect to their effects on surrounding properties. The <br />recommended conditions of approval will help to integrate the proposed uses <br />without detrimentally affecting the surrounding properties and the City in general. <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with surrounding uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-98-53, the application of Carl Rodrigues d.b.a. Carl's Custom <br />Cabinets for a conditional use permit for a cabinet shop within an existing <br />building located at 1032 Serpentine Lane, Suite 103, subject to the conditions <br />shown in Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
