Development shall be substantially as shown on the development plans, Exhibit <br />"A" (dated "Received June 29, 1998"), on file with the Planning Department, <br />except as modified by the following conditions. Minor changes to the plans may <br />be allowed subject to the approval of the Planning Director if found to be in <br />substantial conformance to the approved exhibits. <br /> <br />2. This design review approval shall lapse within one year from the date of approval <br />unless a building permit is issued and construction has commenced and is <br />diligently pursued toward completion or an extension has been approved by the <br />City. <br /> <br />3. The applicant shall enter into an in-lieu parking agreement in accordance with the <br />Municipal Code provisions for ten (10) parking spaces for this project (assuming a <br />supplemental off-site parking lot is approved), or for whatever parking deficiency <br />exists based on actual parking spaces provided and on Code requirements in place <br />at the time a building permit is issued. Said agreement shall be approved by the <br />City Council prior to issuance of a building permit for the project. If approved by <br />the City Council, the agreement may provide for a deferred payment of the in-lieu <br />fee until such time as a public parking lot is constructed in the vicinity ofthe <br />project site, may include provisions for payments to be spread out over several <br />years, and may include "credits" for dedication ofland and/or public street <br />improvements. <br /> <br />4. All on-site parking spaces shall be reserved for customer use at all times. Off-site <br />parking spaces located in the parking lot at 4287 Stanley Boulevard shall be <br />utilized solely by employees of all tenants within the building. The applicant shall <br />prepare a deed restriction to this effect and all tenant lease agreements shall reflect <br />this restriction. The applicant shall submit both the deed restriction and a sample <br />lease agreement to the City Attorney for review and approval prior to recordation <br />of the deed restriction. The recordation shall be accomplished prior to issuance of <br />building permits. <br /> <br />5. All on-site parking spaces shall be shared and made available equally to all tenants' <br />customers. At no time may parking spaces be designated or reserved for any <br />particular tenant or its customers, and no signs or markings shall be placed on the <br />parking lot which reserve parking, except for handicap or compact spaces. <br />
